Petal Host respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
1. Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on a site hosted by Petal Host, please send a written DMCA notice that includes the following:
- Your name, address, telephone number, and email address
- A description of the copyrighted work you claim has been infringed
- The exact URL or location on our servers where the material is located
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement made under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
- Your electronic or physical signature

2. Counter-Notification
If you believe your material was removed or disabled by mistake or misidentification, you may file a counter-notification. It must include:
- Your name, address, telephone number, and email address
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- A statement that you consent to the jurisdiction of the federal district court in your district and that you will accept service of process from the person who provided the original DMCA notice
- Your electronic or physical signature
Send your counter-notification to the same email address listed above with the subject: DMCA Counter-Notification.
3. Repeat Infringers
Petal Host will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.
4. Misuse of DMCA
Please be aware that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability.
